1. Acceptance of Terms

By accessing or using RoofCatch ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including roofing businesses and their representatives.

2. Description of Service

RoofCatch provides an AI-powered receptionist service for roofing businesses that answers inbound calls, qualifies leads, and books estimates on your behalf. The Service includes voice AI, SMS follow-up, calendar integration, and lead management tools.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. You must provide accurate and complete information when setting up your account.

4. Call Recording Compliance

You are solely responsible for complying with all applicable federal, state, and local laws regarding call recording and AI-generated voice interactions, including but not limited to the Telephone Consumer Protection Act (TCPA) and applicable state wiretapping laws. You agree to provide all required disclosures and obtain all required consents from callers before using the Service.

5. Payment Terms

The Service is billed monthly following a one-time setup fee. Payments are due at the start of each billing period. All fees are non-refundable except as described in our 30-Day Guarantee. We reserve the right to suspend the Service if payment is not received within 7 days of the due date.

6. 30-Day Money-Back Guarantee

If RoofCatch does not generate at least 2 booked estimates for your business within the first 30 days of active service, we will refund your setup fee in full. This guarantee applies to new customers only, requires the service to be properly configured and active, and excludes circumstances outside our control.

7. Acceptable Use

You agree not to use the Service for any unlawful purpose; to impersonate any person or entity; to send spam or unsolicited communications; to interfere with or disrupt the Service; or to attempt to gain unauthorized access to any part of the Service.

8. Limitation of Liability

To the maximum extent permitted by law, RoofCatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or revenue, arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.

9. Termination

Either party may terminate the Service at any time with 30 days written notice. We reserve the right to terminate or suspend your account immediately for violation of these terms. Upon termination, your data will be retained for 30 days before deletion.

10. Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
